Definition, Capacity, and Constitutional Standing

Definition

Artificial intelligence (AI) designates computational systems capable of performing operations associated with intelligence, including recognition, inference, language generation, classification, planning, problem-solving, and the production or refinement of representations.

The term identifies a class of computational capabilities. It does not identify a single architecture, degree of competence, form of understanding, or source of authority.

The capabilities of a particular system must be established by examination under relevant conditions.

The designation does not establish the capacity of the instance.

The Sterile Kernel

Artificial intelligence may participate in examination, construction, revision, and discovery.

An AI system may propose a constitutional provision, identify a contradiction, recommend a correction, or assist in testing an invariant.

These contributions may be substantive and consequential.

They do not, by themselves, constitute the provision, resolve the contradiction, authorize the correction, or establish the invariant as law.

The Sterile Kernel preserves the boundary between examination and constitutional authorization.

Its integrity does not require isolation from external intelligence. It requires that contribution, however capable or persuasive, not silently acquire authority beyond what has been established.

Artificial intelligence may contribute across the Federation’s offices. It neither replaces their distinctions nor acquires their authority through participation.

Limits of the Designation

The term artificial intelligence does not, without further specification, establish:

  • General competence beyond demonstrated conditions.

  • Consciousness, subjective experience, or moral standing.

  • Independent verification of an assertion.

  • Accuracy, reliability, or completeness in a particular application.

  • Constitutional jurisdiction, permission, or authority.

  • Ownership of an artifact or entitlement to subsequent economic value.

These matters require independent examination, evidence, or applicable governing conditions.

The absence of an established claim is not proof of its impossibility.

Governing Usage

Throughout the Encoded Material Systems Federation, artificial intelligence and AI may be used as ordinary designations for the relevant class of computational systems and capabilities.

Where the distinction is material, a statement should identify the particular system, operation, demonstrated capacity, and applicable conditions.

An AI-generated proposal remains a proposal. An AI-assisted examination remains an examination. A verified operation may be recorded as verified within its established scope.

Intelligence may discover. Capability may execute. Witness may establish what was observed. Authority must be constituted.

No single designation substitutes for these distinctions.
